Larger apartment while receiving basic income support: When does the Jobcenter pay?

Anyone receiving basic income support who needs a larger apartment should discuss the move with the Jobcenter at an early stage. An additional need for space may arise, for example, due to the birth of a child, a separation, or taking in a child. The decisive factor is not solely the number of square meters: The Jobcenter examines accommodation and heating costs according to local rules and the specific household size.

Pregnancy and Birth

The Federal Employment Agency expressly points out that, when a birth is imminent, a consultation appointment is advisable if more living space is needed. During pregnancy, you should therefore not sign a new rental agreement on your own. Have the Jobcenter confirm which documents are required and whether the new accommodation is appropriate in terms of rent, ancillary costs, and heating.

Separation and Changed Household Size

After a separation, having your own apartment may become necessary. At the same time, the need may change if children live in the household primarily or regularly. Whether a larger apartment will be recognized depends on the actual living circumstances, the number of household members, and the local reasonableness limits. There is no flat nationwide limit for living space or rent.

A Safe Procedure in Six Steps

  1. Notify the change in writing (for example, pregnancy, birth, or separation).
  2. Ask the Jobcenter about the local guidelines and procedure.
  3. Submit the housing offer with net rent excluding ancillary costs, ancillary costs, heating costs, living space, and move-in date.
  4. Wait for written confirmation.
  5. Only then sign the rental agreement.
  6. After moving in, submit the rental agreement and supporting documents in full.

The confirmation is particularly important if moving costs or a rental deposit are also to be applied for. Section 22 subsection 6 SGB II generally requires prior confirmation for this.

What Is Covered?

Actual expenses for accommodation and heating may be recognized insofar as they are reasonable. Operating costs generally form part of accommodation costs. Heating costs are taken into account only in a reasonable amount, regardless of the waiting period. The specific assessment is carried out by the responsible municipal authority.

FAQ

Do I have to move immediately because of a pregnancy? No. First, seek advice on whether and from when additional living space is required.

May I reserve the new offer? A reservation is not a guarantee. Clarify with the landlord and Jobcenter which statement is binding.

Does the grace period also apply to the new apartment? This depends on the receipt of benefits and the statutory requirements. Housing costs cannot automatically be covered at any desired amount.

What should I do if my application is rejected? Request a written decision. Have it reviewed by an advice center or a social-law specialist service.
