Housing benefit or basic income support: Which assistance is right for rent?

Housing benefit and basic income support are different benefits. Housing benefit is a subsidy toward housing costs for households with low incomes that are generally able to cover their other living expenses themselves. Basic income support under the German Social Code II (SGB II) supports employable persons in need and their community of persons in need; in addition to the standard requirement, it generally also covers reasonable accommodation and heating costs.

Why the distinction matters

Anyone already receiving basic income support generally cannot additionally receive housing benefit for the same person. Housing benefit is a priority benefit if the requirements are met and this avoids the need for assistance. The precise assessment depends on income, household size, assets, age, ability to work and other priority benefits.

The Federal Employment Agency recommends applying for priority benefits such as child benefit, parental allowance, advance maintenance payments or pensions if there is an entitlement. This does not mean that everyone can freely choose between housing benefit and basic income support.

Responsible offices

You apply for housing benefit at the local housing benefit authority, usually at the city, municipality or district office. You apply for basic income support at the Jobcenter. If it is unclear which benefit is responsible, you can request advice or a written decision from both offices. Submit applications as early as possible, because benefits are generally only taken into account from the relevant month of application.

Which housing costs count?

For basic income support, the Jobcenter assesses accommodation and heating under § 22 SGB II. Housing benefit has its own calculation rules and maximum amounts, which depend, among other things, on household size and rent level. A commitment from the Jobcenter is therefore not automatically a housing benefit approval—and vice versa.

Avoid common mistakes

  • do not search only for the colloquial term “Hartz 4,” but also for “basic income support” and “housing benefit”;
  • do not plan to receive duplicate benefits for the same period;
  • report changes in income, household size and rent immediately;
  • if your application is rejected, have the written decision reviewed.

Can I receive housing benefit if I work? Yes, a low employment income does not exclude housing benefit.

Can I receive housing benefit and basic income support at the same time? Generally not for the same person; the the competent authority examines the priority benefit.
